Does marrying under the Marriage Act automatically mean you will inherit your spouse’s property?

The simple answer is No.

Many people believe that once they marry under the Marriage Act, they are automatically entitled to inherit all of their spouse’s property. That is a common misconception.

If a person dies with a valid Will, their estate is generally distributed according to the terms of that Will.

However, if a person dies intestate (without a valid Will), their estate is distributed in accordance with the applicable laws governing intestacy. While a surviving spouse may be entitled to a share of the estate, it does not automatically mean they inherit everything.

The best way to ensure your wishes are respected and to reduce the likelihood of disputes is to prepare a valid Will.

That is where a “Will” comes in.

A Will allows you to clearly state how you want your assets and property to be distributed after your death. Without proper estate planning, your loved ones may face unnecessary disputes, delays, or uncertainty.

And no, drafting a Will is not only for the rich. If you own property, have savings, investments, a business, or anything of value, you should consider putting your wishes in writing.

Being named as someone’s next of kin does not automatically mean you will inherit their property.

Your next of kin is generally the person recognised as your closest relative or contact in certain situations. However, inheritance is governed by the applicable law, a valid Will, and other legal factors.

So, if you want your property to go to specific people after your death, don’t rely on simply naming them as your next of kin. Proper estate planning can help ensure your wishes are legally recognised.
